Dear Mr. Keller,
I finally finished the translation of the debit confession act, executed by Lucio Azzoni, which BSI SA - Lugano claimed as false.
Perhaps after reading it you may come to some conclusion on the motive
the bank would give me a false collateral document, because I've
already run out of ideas (if it is false - now the Forensics will tell).
I don't know if you are still having difficulties in open .pdf files,
so I'm sending the Debit Confession Term and the Promissory Note in .JPG
and the this chapter of the saga plus the document translation in .doc.

If it helps regarding the report you were required to present in the behalf of L'Inchiesta, there are some more info that might help you.
The pecuniary damage BSI assumed on Jan/31/2003 brought to present value
according to the debit confession act provisions [PN face
value overdue + penalty of 20% of face value + CDI pro rata from Jan/31/2003
to Jan/23/2003 = 22.07%] in US Dollars (exchange rate of R$
2.8420 - base Jan/23/2004) =
US$ 6,352,265.16
If you consider the link of AASP (Lawyers Association of São
Paulo) where moral damages related to banks malpractices ranges
between twice and 30 times the pecuniary value, you may consider BSI
might have to pay me if the judge sentenced today, damages
ranging from:
US$ 12,704,530.32 to US$ 190,567,954.80
Note that when BSI assumed the pecuniary damage on 29/01/2003, the exchange
rate between Brazilian currency and US Dollars was
US$ 1.00 = R$ 3,928 (market price) it means that the pecuniary damage
to be restored in said occasion was US$ 3,013,883.54. Then
when BSI offered the settlement on Oct/13/2003 same exchange rate had
changed to US$ 1.00 = R$ 2.86 (market price), that may be the
reason why they said the document was false. I don't know.
